Need suggestions on a recent transaction with northcarolinag

Hi there, guys. I need your professional input on my recent transaction with northcarolinagal.
He was selling a brand new HP Dual TV Tuner USB kit, which he didn't specify "SOLD As-Is" btw, therefore I assume it's in full working order.
I bought it and when I got it in my hand, I couldn't get it to work. I've tried windows media center 2005 and even installed windows vista ultimate to test the tuner.
The really weird thing is that the tuner shows up as an "Unknown device" with no hardware ID in Device Manager.
Also I've tried the tuner on three different computers, no go!
I've contacted the seller and here is his latest reply:
"i really dont know because like i said when i sent it to you it was brand new only moved out of the unopened box into another one for shipping. also since it was new i didnt give a guarantee on it anyway. so dont know what to say.
"
So the seller is apparently trying to get away by implying SOLD AS IS.
What do you guys think?
