Shipping T41p to IBM service without a hard drive...

So the fan just died on my T41p :( I smelled something burning, but luckily I was able to just promptly shut down "properly" without it actually blowing up. Now I called IBM and I am shipping them the machine for service, but when I asked whether I can take out my hard drive they said I can't.

Now I know, and you know, and even the guy on the phone admitted that the hard drive is not relevant, but he said that I can't ship it back without it... My question is, what prevents me from doing it anyway? Is there going to be a problem if I ship it without the hard drive with a note in the box?

The two times I shipped my Thinkpad to IBM for service I was told to remove the hard drive, and anything else that wasn't related to the problem.

I have always pulled the hard drive when shipping to the repair depot but maybe there is a new policy in place now?
T60 2623-D7U, 3 GB Ram.
Dual boot XP and Linux Mint.
