Fan Problems...//New Unit for Excessive Problems?

My T42p has been shutting down randomly, and now I know why: When I booted my system, it said "Fan Error" on the screen, and then booted, so I am guessing that the fan has gone bad.

NHC showed the CPU @ 111 F and HD @ 93 F before I shut down the system.

This will be my 4th or 5th time sending the unit in (defective ethernet port, then incorrect system board when they replaced it, bad LCD after about a 1/2 year, keyboard problems, bad CD drive, etc).

My question is: At what point would I be justified in asking if I can get a replacement unit instead, and how would I escalate issues high enough to be able to get a new unit if so desired? (I have had the unit since January 2005 and the TPP expires in January 2009).
