Is ibmfactoryoutlet a good guy or not?

Hi all,
Just wanted to get some input from people with respect to the ebay seller who goes by the name of, "ibmfactoryoutlet". I have heard some good things and not-so-good things.
Bottom line is, I understand reading the fine print from the seller. However, I placed my bid on a "brand new, factory sealed" x61. Yes, it has the free upgrade to 3GB RAM, so they had to open the laptop to insert the RAM. But I cannot see how they could call the machine "brand new" if it is, indeed, a refurbished laptop.
The price is pretty incredible, so I wouldn't be surprised if something is up.
Any insight/comments would be much appreciated. Bill, thanks for the late-night investigation.
