Problem with X61 tablet pen

I recently received an X61t from Lenovo and the pen seems to be malfunctioning. It acts as if I am touching the screen even though its an inch above the screen (always highlighting stuff). Any thoughts how to fix this? Does it sound like the pen or a digitizer problem?

Also the two portions of the pen twist... not sure that they should since I wound up with the pen stuck in the laptop when the button was turned away from the clip.

I cannot call support right now because the X61t doesn't show up with a warranty right now. I cancelled the order and it still shipped out (I couldn't resist opening the box yesterday) so it will probably take a bit to get it sorted out on Monday.

On the plus side, the touch screen portion works ok.... but I think the X61t will be too big and heavy to use as an ebook reader (I will also use for browsing web and email to supplement my T61p). I am thinking a Fujitsu P1610 is more what I want.

The two pieces of my pen don't twist, but it does highlight things like links, buttons etc when it's about an inch from the screen. I think that's normal. It doesn't actually activate anything, though.

From what I understand touching the screen with the pen should select things right like the mouse button. That doesn't seem to work. All I get is the highlighting stuff when an inch from the screen. I cannot get it to work like a mouse click. I tried the calibrate, but touching the display with the pen on the calibration spots does nothing.
