If you purchase a TP on ebay from someone who says they got it from an employee purchase do you know if IBM will still honor the 3 year and can you still get the restore disks?

Yes, the warranty follows the machine as long as it is not stolen. You can get restore disks but you will have to pay $45/set. You will have to pay this even if you have bought the machine originally yourself.
If the pre-desktop partition is still intact and a set of recovery discs hasn't been made yet, you can make your own set of recovery discs. You are allowed to make one set.
