about ebay refunding...

about ebay refunding...
hi there,
so the problem is that instead of a ac/cd combo slim adapter i got the big adapter, not the slim version.
the seller agreed imidiatelly to send it back, i did.
now the question is: who should pay the return shiping costs? me or him?
it was not specified on the auction.
thing is that it costed 35usd and shiping 25usd. now if i send it back and he gives me only the 35usd back its pretty much not worht it cause i will have to pay 30usd to send it to states.
so overall i would pay 90 usd (item+ship to me+ship back) and get back 35, so 55usd will be the shipping costs, which is not my fault he presented it as a slim version when he had the big version...
what do you think?

I have done a few ebay transactions - as a buyer only. I do not know the general way this is handled, but IMO the seller should cover all costs if the item was clearly misrepresented.
As a buyer, I have run across misrepresented items before. If there seems to be any possibility that the seller really does not know what they have, I send them a message requesting verification of the features in question. Avoids problems all around.

In all honesty he should pay to have you ship it back to him and he should cover all costs, but there is probably about %1 off ebay sellers that would do that. chock up your loss and eat the shipping back to him and get the ball rolling. the longer it takes the longer you wait to get your product back.

The physical description and FRU (22P9010) stated in the auction is the original (heavy) AC/DC adapter. The listed weight exactly matches the ones that I have (FRU 22P9021). The "40 percent thinner" version is FRU 73P4485 so it appears the seller used that description without knowing the difference. Look at what else he/she is currently selling, and you will see that the adapter is NOT a normal item.
In my opinion both of you are "in the wrong", but the seller more so. (S)He should cover the return shipping for the mistake in the description but as a good will gesture, I would offer to cover half of the shipping.
If you look at the past negative feedback, the two negatives the seller received were for a "fake" item and a misrepresentation.

If you still have the adapter, I would simply keep it and re-sell it locally (or on eBay) as it appears that is your best way (financially) out of the situation. Those adapters have been selling for $35-45USD recently, although the three I bought in the last couple of weeks were for $25 (they were missing the AC cord; easily replaced).
A little bit a gentle persuasion showing the difference in the two adapters may be enough to show the seller's error:
IBM/Lenovo 73P4485 adapter
IBM/Lenovo 22P9010 adapter
Point out the differences in the physical dimensions and I believe you should be able to make your case.

How did you pay for it?
If you used Paypal, file a complaint to get ALL of your money returned for an item received not as described.
The fact that the seller has received no other complaints for similar sales simply means that the other purchasers are unaware of the differences in power bricks.

ok, in the end he seems to be a nice guy.
he agreed in refunding everything i paid plus 50% of the shipment cost to send it back to him.
overall, i can live with it...i spoke to ebay(paypal as well), and they said they can only assure i get back what i paid, and have to send back the item, and shiping from switzerland is more ex than from us... but at least i recover a big part of the money.
[censored], that power brick is huuuge!!! i mean i was shocked when i;ve seen the 72w from my r53 from work (comparing with the tiny one of x40), but that adapter is....the wall of china...
