Speckled screen - dust in front of backlight?

I just bought a used T42 in "as new" condition. Panasonic battery, first used 12/2004, runs 2.15h or so. Case in very good condition.
However, there's lots of what looks like dust blobs near and at the center of the screen (15" SXGA version).
The dealer tried to tell me this was an issue with virtually all older IBM notebooks, but I cannot really believe that, having read all the good things about the longevity of these devices here and elsewhere.

Here is a photo of the screen. The effect is much more obvious in reality, and the blobs are less visible the steeper the angle is from which I look at the display. Viewed completely from the side, they're invisible. From 90°, it looks pretty terrible.

Image is large and its size is 3 MB. Should be viewed at 1:1.. there's moire and scaling makes it look worse.

According to German law, I can return it within 14 days for a full refund, or demand a fix (the dealer seems to profoundly dislike the latter idea and says he doesn't have replacement units, but the law is the law).
Of course I could also contact IBM customer service since it's still within the 3 years warranty period. However, if they refuse to fix it, the refund period will be over, and unlike the dealer, they are not bound by law to do anything.
What do you think I should do?

same problem here... T43 with 15''.
