Any lawyers in here?

#1 Post by Turbo Audi » Wed Oct 10, 2007 4:48 pm

Hey everyone! Been awhile. I need some legal advice about a simple issue I am having. I am thinking strongly of taking someone I know to small claims in Massachusetts.
If someone could hear my short story and give me advice I would appreciate it greatly. I have a few neighbors that are lawyers but I have yet to get around to talking with them. Just throw me a PM. Thanks.

Attorneys should be warned to Beware the Unauthorized Practice of Law in Cyberspace.

Specifically:
Licensed attorneys also need to be aware of unauthorized practice rules when they have a Web presence. FOOTNOTE 8. One reason is that an attorney licensed in one state may unwittingly develop an attorney-client relationship with a client in a state where the attorney is not licensed. FOOTNOTE 9. The problem can arise in connection with an interactive site, an Internet chat room, where a lawyer communicates with an individual in another state, unsolicited e-mail ads ("spam"), in moderated discussion groups and online forums, bulletin boards, listservs, blogs, etc. FOOTNOTE 10.

Indeed, the New York City Bar Association has suggested that "almost any question and answer may in fact constitute legal advice, even if the questioner does not appear to be seeking 'specific' legal advice." FOOTNOTE 11. Nevertheless, the extent to which specific questions are addressed by the lawyer instead of provision of general topical information to the public at large is the gravamen of the analysis no matter what form of electronic media is used.

Not surprisingly, questions of whether a lawyer is participating in the unauthorized practice of law outside of the jurisdiction in which the lawyer is admitted have been analogized to the more developed analysis concerning the exercise of jurisdiction over any site. In either analysis, the key question is the extent to which a visitor is invited to interact with the site. There is a wide continuum of sites, ranging from those that are completely passive, the equivalent of an electronic magazine ad, to those that are wholly interactive and encourage individual input by the visitor and personalized response to that input.
