New FS Marketplace rule #11

In this post, Ray pointed out for everyone “New FS Marketplace” rule #11:

As I read the rule, it only applies: a) if the machine is offered with something other than the original OS; or b) if additional software is offered as part of the sale.

It doesn’t appear the rule, as written, requires the seller to certify there is a COA on a machine being offered with the original OS. I’m therefore confused about questions regarding COA’s on machines where it appears the original OS is what is specified.

If the intent is to ensure machines have COA’s I suggest adding something like: “If the machine is being sold with the original OS, seller must specify whether there is a COA on the machine.”

I think it should be stated regardless whether it has the original OS installed or not. If a different commercial OS (or commercial software) is installed, the COA (must) and the Install Media (preferably) should be included and stated as such.

Just my 2 cents. I don't make the rules.

It seems like the intent is to ensure that any and all software, including OS's, that come with a machine are properly licensed. Rule #11's intent is made pretty clear, below is a quote from the rule;

To be blunt here, NO hacked OS's and/or commercial software will be sold on this forum.

Presumably that means that if a machine has a COA on it, then the OS listed on the COA is liscensed. It would be nice to know if the machine comes with the recovery partition and/or original or copies of recovery disks, but that probably doesn't have to be required - a PM exchange can work that out, if it's important to the potential buyer.

Any OS other than that listed on the COA and any other software that is included, must either 1) be freeware, like Ubuntu or OpenOffice.org, or 2) include a legal license and software key, if required, not a copy, and potentially, the original install media or a copy, if original is not available or was not provided (due to a download purchase, etc.)

Otherwise, software really shouldn't be listed in a for sale ad.
