R40e shuts off running on a full battery

hi.

i just bought an r40e with windows xp home edition v.2.2 service pack 3.

the problem is when i unplug the ac adapter with a fully charged battery it shuts down within a minute or two, no alarms, nothing, just off, black screen and wont come back on until i put the ac back in, then when i do plug it back into the ac and look at the battery meter it still shows a 98% charge. also, if i leave it in sleep mode and unplug the ac it will drain down, i havent let it go all the way but it has gone to 60% charge. so thats suggesting the battery does work i think? just when on and trying to run at full power shuts off very quickly. it also shuts off alot on ac power when the battery is in the machine, if i take the battery out it seems to run ok, no turn offs. i also got a blue screen with the IRQL_NOT LESS OR EQUAL error a few times and one long beep and two short ones, which is a video card problem i read.

ive updated the bios with the latest relaease i can find. a 2005 one? and used memtest86 3.5, it passed.

My guess is a defective battery,
